Section 504 of the Rehabilitation Act

What is a 504 plan:
+ Section 504 of the Rehabilitation Act of 1973 states that students with disabilities will not be discriminated against based on their actual or perceived disability

+ a 504 is an accommodation plan that helps to support students dealing with a mental or physical disability

+ 504's are based on medically diagnosed or perceived disabilities.
Disabilities Defined:

+ any physical or mental impairment which substantially limits one or more life activity

+ life activities may include caring for one's self, walking, seeing, hearing, speaking, breathing, working, performing manual tasks, and learning

+ 504's can be written for any number of physical or mental disabilities which can include some of the following: anxiety, depression, broken leg/arm, ADD, reading/processing disorders, severe migraines, deafness or hearing impairment, any major medical condition, etc

+ 504's are designed to give students a level playing field with their peers either academically or socially

Differences between a 504 and Special Education:
 + although a 504 plan falls under the special education umbrella, a student on a 504 plan is not considered to be a special education student

+ special education students will be put on an individualized education plan (IEP) and will have a designated case manager

+ students on an IEP will often work with a special education teacher and may split time between special education classrooms and mainstream classrooms, students on a 504 will remain in the mainstream classroom.

+ 504 plans have less specific qualification criteria in comparison with an IEP, students on an IEP must meet very specific qualifications.

+ an IEP can provide added teacher support through the use of a case manager or paraprofessional while a 504 plan typically contains accommodations that a classroom teacher can provide without additional support.
